To: Senator Ernest Hollings D-SC From: Robert X. Shuster Executive Director The Shuster Project-Tobacco Industry Fraud & False Claims Issues C/O 177 Andrew Avenue Naugatuck, CT 06770 Re: Commerce-Justice-State Appropriation Funding Resource Alternatives 7/21/2000 To The Honorable Senator Hollings, Although The Shuster Project is based in Naugatuck, CT, the work we are doing has a direct relationship with the work you are doing relative to the tobacco industry. We can, however, provide you with invaluable information and assistance in securing more than adequate funding for the U.S. government's litigation against the tobacco companies by pointing you to the means to recover an enormous sum as a result of tobacco companies federal Income Tax Fraud to which the IRS, thanks to the information we have provided them, has now acknowledged has taken place for over 45 years and, with interest and penalties, amounts to well over $1 BILLION Dollars. We, at The Shuster Project, ask that you direct your staff to go to this "chapter" of our web site: http://rxshuster.org/federal.htm and http://rxshuster.org/contigen.htm The first page will introduce you to the IRS involvement in this matter and their attempt to now disavow every acknowledgement they made to us of this vast sum of defrauded tobacco industry federal Income Tax revenue. The second page will illustrate the actual tobacco industry document by which this BILLION Dollar federal Income Tax Fraud was perpetrated and that the IRS acknowledged they had no prior knowledge of....either the existence of the "Contingency Form" itself AND/OR the federal Income Tax Fraud scheme that continues unabated to this day despite having been told of it several times now. If you direct your staff to go to this page: http://rxshuster.org/janet_reno.htm you will find a letter we sent to Attorney General Janet Reno on June 20th, 2000, well in advance of the Florida $140 BILLION DOLLAR Jury Award during which time she could have initiated proceedings to secure the federal governments stake in this $1 BILLION Dollar tobacco industry federal Income Tax Fraud scheme to help fund the governments litigation, yet she did absolutely nothing about this, either. If her fear was the Master Settlement Agreement between the states and the tobacco industry, the MSA expressly preserves the right of states to bring any criminal actions that may be warranted. The settlement has no bearing on any such criminal proceedings, whether grounded in federal, state, or local law. [MSA XII(a)(7)]. The agreement also makes an express exception for state suits concerning tax liabilities or liabilities under any licensing fee provisions.[MSA II(nn)(1)]. Finally, the agreement does not preclude the states from going to court to enforce the commitments undertaken by the tobacco companies in the settlement agreement and the associated consent decrees. We, at The Shuster Project, stand ready to assist you in both addressing this one of dozens of issues of tobacco industry Fraud & False Claims...the federal Income Tax Fraud issue with it's $1 Billion Dollar plus recovery potential...and to provide you with any witness-required assistance you may require in order to recover even an initial, "small," "starting" sum that can easily be far more than the $21 Million Dollars in appropriations you are presently seeking. If you take the necessary actions NOW to begin the process of recovery and take it away from the IRS and Janet Reno who's intentions clearly appear to be choosing to ignore this huge sum and the federal Income Tax Fraud crimes themselves, that process will clearly be successful and yield a huge sum that the federal government can utilize in their lawsuit against the tobacco companies than there is any security in continued appropriations to be approved in either the House or Senate. I look forward to hearing back from you in this regard. Please acknowledge receipt of this email correspondence and also please detail what you intend to do with the information we have provided to you relative to informing you of federal Income Tax Fraud activity on the part of the tobacco companies as a very real resource of funding by the government in their lawsuit against the tobacco companies. As is our custom, this letter will appear in our CORRESPONDENCE 2000 page for public review. Sincerely, RXShuster C/o 177 Andrew Avenue Naugatuck, CT 06770-4359 Telephone: (203) 723-9266 Fax: (801) 705-3078 Email: rshus177@aol.com Voice Mail: (203) 747-1954 ext. 114
