To The Honorable Maryland Delegate John Hurson - District 18 - Montgomery County, Dear Sir, Your name has arisen in the print media here as being one who is attempting to responsibly address the issue of how best to invest the MSA moneys to the best advantage of youth smoking and it's cessation. The Award-winning "The Shuster Project" web site at: http://www.rxshuster.org/ stands alone in addressing the issues of tobacco industry Fraud & False Claims. As a former 17+ year employee of the former American Tobacco Company, I attempted to address and correct the issues of tobacco industry Fraud & False Claims from within the industry, which was eventually why I was "removed" from my position there. We are corresponding to you this day because there are dozens of issues of tobacco industry Fraud & False Claims, including but not limited to tobacco industry state Income Tax Evasion and Fraud, state's Sales Tax Fraud, Antitrust violations and much more that the MSA has never addressed. On the issue of tobacco industry state Income Tax Evasion and Fraud alone, it is conservatively estimated that the amount of defrauded revenues exceeds $1.3 BILLION Dollars going back 40 years. There are no statute of limitations on Income Tax Evasion when fraud can be proven. The Shuster Project can prove and illustrate the fraud. That state Income Tax Fraud continues to this day, including in the state of Maryland, unabated. On the issue of tobacco industry state's Sales Tax Fraud alone, it is conservatively estimated that the amount of defrauded revenues exceeds $45-$60 Billion Dollars going back 40 years. To the best of our knowledge, there are no statute of limitations on state Sales Tax Fraud when fraud can be proven. The Shuster Project can prove that fraud, also. And that state's Sales Tax Fraud continues to this day, including in the state of Maryland, unabated. As you can see, just two "categories" of tobacco industry Fraud & False Claims exceeds $61 BILLION Dollars in defrauded Tax Revenues. With the proper "corrections" made to just those two categories of tobacco industry fraud, the "new" tax revenue Income Streams that will be realized can become "dedicated" revenues to infinitely fund a series of developed youth, young adult, adult, the elderly and disabled smoking cessation programs literally forever using revenues generated by smokers themselves. In addition, these "new" Income Streams would not financially impact non-smokers negatively by causing any increase in taxes (state sales tax, state income tax, property or vehicle taxes) in order to address the needs of the tobacco/health impaired smokers or their medical treatment(s). In other words, by taking the bold steps to correct the crimes of tobacco industry Fraud & False Claims, the corrected state income tax and state sales tax revenues will generate tens of millions of dollars annually for Maryland through smoker purchases that, if dedicated and monitored and tracked properly, would introduce an uninterruptible, accountable, smoker-generated, dedicated set of Revenue Streams (not just for Maryland but all 50 states) that can forever fund smoking cessation programs for every age bracket, which is the logical approach to this issue. I stand ready to assist the state of Maryland as we are already assisting the state of New York, with others now already expressing interest in our programs, our "corrections" initiatives and more, to finally address these issues with an "insiders" knowledge of exactly "where the money is" or in reality, where far more money than the MSA has encompassed The Shuster Project can guide the states and their legislators to far more, as the above stated revenue recoveries indicate.
